1. Acceptance of These Terms

These Terms of Service ("Terms") are a legal agreement between you and QuizTime Labs LLC ("QuizTime Labs," "we," "our," or "us") governing your use of the QuizTime Manager mobile applications, parent web portal, website, and related services (collectively, the "Service"). By creating an account, installing our apps, or otherwise using the Service, you agree to these Terms. When you create an account you will be asked to affirmatively accept these Terms, and we keep a record of the version you accepted and when. If you do not agree, do not use the Service.

Our Privacy Policy, Children's Privacy (COPPA) Policy, and Cookie Policy describe how we handle personal information and are incorporated into these Terms by reference.

2. Eligibility and Parent Accounts

  • You must be at least 18 years old and legally able to enter into a contract to create a QuizTime Manager account.
  • Accounts are created and managed by parents, legal guardians, or authorized educators ("Managers"). Children do not create their own accounts; a Manager creates and controls each child profile.
  • By creating a profile for a child, you represent that you are that child's parent or legal guardian, or that you have been authorized by the child's parent or legal guardian to manage the child's participation.
  • You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us promptly at support@quiztimemanager.com if you suspect unauthorized use.
  • You agree to provide accurate information when registering and to keep it up to date.

3. The Service

QuizTime Manager helps families turn screen time into an incentive for learning. Managers assign quizzes, interactive learning quizzes, and worksheets to children; children earn screen time by completing them. The Service includes an iOS app for children's devices, a parent web portal and app, an optional AI-powered Quiz Builder, an optional AI-assisted worksheet grading feature, an optional AI-powered tutor feature, and a Community Library of shared learning quizzes.

The Service is under active development. Features may be added, changed, or removed at any time, and portions of the Service may be labeled "beta," "preview," or similar. Beta features are provided for evaluation and may be less reliable than the rest of the Service.

Software of any kind contains defects. We aim to correct problems that we consider significant, but we do not commit to providing updates, upgrades, maintenance, support, or a correction for any particular defect within any particular time, and we may discontinue the Service or any feature at any time. Your remedy if the Service does not work as you expect is to stop using it and close your account.

4. Screen Time Features — Important Limitations

Our screen time management features rely on Apple's Screen Time frameworks (Family Controls, Device Activity, and Managed Settings) and on correct device setup. You acknowledge and agree that:

  • QuizTime Manager is a tool, not a guarantee. No screen time control is foolproof. Children may find ways to circumvent restrictions, and software, operating system, or configuration issues may cause limits not to be enforced as expected.
  • We depend on third-party platforms. Changes Apple (or other platform providers) make to their operating systems or APIs may degrade or disable screen time features without notice, and we are not responsible for such changes.
  • You remain responsible for supervision. The Service supplements — and does not replace — your own judgment and supervision of your child's device use, online activity, and wellbeing.
  • You are responsible for configuring devices correctly and for complying with the terms of the platforms you use (including Apple's terms) and with any applicable device or carrier charges.

5. Plans, Credits, and Payments

Free Access: Beta, TestFlight, and Trials

We offer the Service free of charge to some users, including participants in our beta program, testers who install pre-release builds through Apple's TestFlight, and users we grant a time-limited free trial. If you are using the Service under free access:

  • You will not be charged anything for that access, and we will never charge you without your affirmative consent through a checkout or in-app purchase flow.
  • Free access is a revocable privilege, not a purchase. It may be limited in features, children, devices, or credits; it may run for a fixed period; and we may change, suspend, or end it at any time, including by moving the features you are using to a paid plan.
  • Pre-release and TestFlight builds are exactly that — unreleased software offered for evaluation. They are more likely than the released Service to contain defects, to lose data, or to stop working, and they are subject to the disclaimers in Section 13 and to Apple's own TestFlight terms.
  • When free access ends, your account and family data remain, but features that require a paid plan stop working until you subscribe. We will tell you before free access ends where we reasonably can.

Subscription Plans

Paid access to the Service is sold as a recurring subscription. The plans we currently offer, what each one includes, and the current prices are shown on our website and in the app, and again at the point of purchase before you pay. In general terms:

  • Plans differ in the monthly credit allowance they carry and in which features they unlock (for example, printable PDF worksheets, the Quiz Tutor, and invitations for additional managers are available on our higher tier).
  • Each plan includes one child profile and a fixed number of device links per child. Additional children are available as a recurring per-child add-on, purchased through our website, which increases your monthly credit allowance.
  • Each plan may be billed monthly or annually. Annual plans are charged once for the year at a discount off twelve monthly payments, and the corresponding credits are issued for the year.
  • Plan caps are enforced. If you cancel, downgrade, or remove a per-child add-on, you may need to remove children or device links before the change can take effect.

Usage Credits

AI-powered features (such as the Quiz Builder, worksheet grading, and the Quiz Tutor) consume usage credits. Unless expressly stated otherwise:

  • Credits are a limited, non-transferable license to use metered features of the Service; they are not money, property, or a stored-value account.
  • Credits have no cash value, cannot be redeemed for cash, and may expire as indicated when they are granted or purchased. Credits included with a subscription are use-it-or-lose-it: they are granted for a billing period and any unused balance from that grant is forfeited when that period ends and the next grant is issued. On an annual plan, the billing period is the year; you receive the whole year's credit allowance as a single balance when the annual invoice is paid, it does not reset or expire month by month, and whatever is left over expires at the end of the annual term. Credits you buy separately as a top-up pack do not expire while your account is open.
  • Top-up packs are sold only to active subscribers and are consumable — once used, they are gone, and they do not change your plan's caps or features.
  • Promotional, welcome, and trial credits may be modified or revoked at our discretion, and are not refundable.
  • We may change how many credits a given feature consumes as our costs and the underlying AI services change. Material increases will be disclosed before they take effect.
  • Unused credits are forfeited when your account is closed, except that if you close your account because you decline updated Terms, we will refund what you paid for your unused purchased credits as described in Section 17.

Billing, Renewal, and Cancellation

  • Subscriptions renew automatically. Unless you cancel, your subscription renews at the end of each billing period — monthly or annual, whichever you chose — and the payment method on file is charged the then-current price for the next period.
  • You may cancel at any time. Cancellation stops future renewals; it does not refund the period you are already in, and your plan stays active through the end of that period.
  • Where you bought it is where you cancel it. Subscriptions purchased through Apple's App Store are billed by Apple and must be managed and canceled in your Apple account settings; we cannot cancel or refund them for you. Subscriptions purchased on our website are billed through our payment processor and can be managed from the parent portal.
  • If a payment fails, we may retry it, and we may suspend paid features until payment succeeds.

Price Changes

We may change our prices. For an existing subscription, a price change takes effect at your next renewal, and we will give you notice before it does — at least thirty (30) days in advance where required by applicable law or by the app store you purchased through — so that you can cancel first if you do not want to continue. Continuing to use a paid plan after a price change takes effect is acceptance of the new price.

Refunds

Purchases made through an app store are processed by, and subject to the refund policies of, that platform — for Apple purchases, request refunds through Apple. For purchases made on our website, and except as required by applicable law, as expressly stated at the point of purchase, or as provided in Section 17 (declining updated Terms), payments are non-refundable and partial periods are not prorated. Nothing here limits any statutory right of withdrawal or cancellation you may have under the law where you live.

6. AI-Generated Content

The Quiz Builder, worksheet grading, and Quiz Tutor features use third-party artificial intelligence services to generate learning quizzes, to read and grade photographed worksheets, and to provide hints and explanations to a child working through an assignment. You acknowledge that:

  • AI-generated content can contain errors, including factually incorrect questions, wrong answer keys, inaccurate grading, and incorrect or confusing tutor hints. You are responsible for reviewing AI-generated quizzes before assigning them to a child and for reviewing AI-assigned grades. Tutor conversations are recorded and available for your review on the parent dashboard, and you may disable the tutor for any child from the parent portal.
  • AI output is provided for convenience and general educational enrichment; it is not professional educational, psychological, or medical advice, and it is not a substitute for a qualified teacher or curriculum.
  • Information you submit to AI-powered features is shared with our AI provider as described in our Privacy Policy. Do not submit content you do not want transmitted to the provider.
  • Similar prompts may produce similar output for different users, and output may resemble third-party material; we do not guarantee that AI-generated content is unique or non-infringing.

7. Your Content and the Community Library

Your Content

"User Content" means content you create, upload, or submit through the Service, including quizzes you build (manually or with the Quiz Builder), Quiz Builder prompts and attachments, worksheet photos, and profile information. You retain ownership of your User Content. You grant QuizTime Labs a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and process your User Content as needed to operate, provide, secure, and improve the Service.

Sharing to the Community Library

Quizzes you create are private to your family by default. If you explicitly choose to share a quiz to the Community Library:

  • You grant QuizTime Labs and other users of the Service a non-exclusive, worldwide, royalty-free license to view, use, copy, and assign the shared quiz (including for their own children) within the Service.
  • You represent that you have all rights necessary to share the quiz and that it does not infringe anyone else's rights or violate these Terms.
  • Do not include personal information — such as your child's name, photo, school, or other identifying details — in a shared quiz. We run an automated check for your children's names before sharing, but it is a best-effort aid, not a guarantee; you are responsible for reviewing what you share.
  • You may stop sharing a quiz at any time, but copies or assignments other families made while it was shared may persist.
  • The license above survives closure or deletion of your account: quizzes still shared to the Community Library when your account closes remain available to other families unless we remove them or you unshare them before closing your account.
  • We may review, decline, remove, or de-list any shared quiz at our discretion, including for quality, safety, or policy reasons.

Content Standards

User Content — especially content shared to the Community Library — must be appropriate for children and must not include: sexually explicit or suggestive material; violence, hate, or harassment; profanity; promotion of dangerous activities; advertising or solicitation; malware or deceptive code; personal information about any person; or content that infringes intellectual property or other rights.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms;
  • Access or attempt to access other users' accounts, data, or non-shared content;
  • Probe, scan, or test the vulnerability of the Service, or circumvent authentication or security measures;
  • Scrape, harvest, or bulk-download content or data from the Service, or use bots or automated means to access it;
  • Resell, sublicense, or redistribute the Service or its content, or use the Service to build a competing product;
  • Reverse engineer, decompile, or disassemble any part of the Service except where permitted by law;
  • Upload viruses or malicious code, or interfere with the operation of the Service;
  • Impersonate any person or misrepresent your affiliation with any person or entity;
  • Use the Service to stalk, harass, abuse, defame, threaten, or intimidate anyone; or
  • Misuse AI-powered features, including attempting to generate content that violates the Content Standards above.

9. Intellectual Property

The Service — including its software, design, graphics, logos, built-in quizzes and quizzes, and all other materials other than User Content — is owned by QuizTime Labs or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial family or classroom use in accordance with these Terms. No other rights are granted.

If you send us feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation.

10. Copyright Complaints (DMCA)

We respect intellectual property rights and respond to notices that comply with the Digital Millennium Copyright Act. If you believe content on the Service infringes your copyright, send a notice to support@quiztimemanager.com including: (a) identification of the copyrighted work; (b) identification and location of the allegedly infringing material; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement, under penalty of perjury, that the notice is accurate and you are authorized to act for the copyright owner; and (f) your physical or electronic signature. We may remove allegedly infringing content and may terminate the accounts of repeat infringers.

11. Third-Party Services

The Service interoperates with third-party services, including Apple's Screen Time frameworks and third-party AI providers, and may link to third-party websites. We do not control and are not responsible for third-party services, their availability, or their terms and privacy practices. Your use of a third-party service is governed by that third party's terms.

12. Termination

You may stop using the Service and delete your account at any time from the account page on QuizTimeManager.com, in the iOS app account view, or by contacting support@quiztimemanager.com. We may suspend or terminate your access to the Service (in whole or in part) at any time, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or if we discontinue the Service. Upon termination, your license to use the Service ends; provisions of these Terms that by their nature should survive (including Sections 6, 9, and 13–17) will survive.

Data deletion following account termination is described in our Privacy Policy.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; DEFECTS WILL BE CORRECTED; DATA YOU OR YOUR CHILDREN SUBMIT OR GENERATE (INCLUDING QUIZZES, ASSIGNMENTS, EARNED SCREEN TIME BALANCES, AND CREDITS) WILL BE PRESERVED, BACKED UP, OR FREE FROM LOSS OR CORRUPTION; SCREEN TIME LIMITS WILL BE ENFORCED IN ALL CIRCUMSTANCES; EDUCATIONAL CONTENT (INCLUDING AI-GENERATED CONTENT AND COMMUNITY LIBRARY CONTENT) WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR CHILD; OR THAT USE OF THE SERVICE WILL ACHIEVE ANY PARTICULAR EDUCATIONAL OUTCOME. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

14. Limitation of Liability

NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FOR FRAUD OR FRAUDULENT MISREPRESENTATION, OR FOR ANY OTHER LIABILITY THAT APPLICABLE LAW DOES NOT PERMIT US TO EXCLUDE. THE REMAINDER OF THIS SECTION APPLIES ONLY TO THE EXTENT PERMITTED BY THE LAW THAT GOVERNS YOUR RELATIONSHIP WITH US, AND IF ANY PART OF IT IS HELD UNENFORCEABLE, THE REST REMAINS IN EFFECT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUIZTIME LABS AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) AND (B) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

15. Indemnification

You agree to defend, indemnify, and hold harmless QuizTime Labs and its officers, members, employees, and agents from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your User Content, including quizzes you share to the Community Library; (b) your violation of these Terms; or (c) your violation of any law or the rights of a third party in connection with your use of the Service.

16. Dispute Resolution; Governing Law

Informal Resolution First

Before filing a claim, you agree to contact us at support@quiztimemanager.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days.

Binding Arbitration and Class Action Waiver

Except for disputes that qualify for small claims court or that seek injunctive relief for intellectual property infringement, any dispute arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and QuizTime Labs each waive the right to a trial by jury and the right to participate in a class action. Disputes will be arbitrated only on an individual basis and will not be consolidated with the claims of any other party.

Opt-out: You may opt out of this arbitration agreement by emailing support@quiztimemanager.com within thirty (30) days of first accepting these Terms, stating your name, account email, and your intent to opt out of arbitration.

Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to its conflict of law provisions. Any claims not subject to arbitration must be brought exclusively in the state or federal courts located in Indiana, and you consent to the jurisdiction of those courts.

17. General Terms

  • Changes to these Terms. We may update these Terms from time to time. If we make material changes, we will notify you by email, in-app notice, or a notice on our website before the changes take effect, and we will present a summary of what changed in the app and parent portal. You will be asked to review and accept the updated Terms before continuing to use the Service.
  • If you do not accept updated Terms. You may decline updated Terms from the review screen in the app or parent portal. Declining closes your account: (a) we will refund, in full, the amount you paid for any unused purchased credits remaining on your account, to your original payment method where possible; (b) promotional, trial, and subscription-allowance credits have no cash value and are not refunded; and (c) your account will be closed and your personal information and family data deleted as described in our Privacy Policy, with transaction records retained as required for refund processing, accounting, and legal compliance; and (d) quizzes you shared to the Community Library remain available under the license in Section 7. Until you accept or decline, your access to the Service (other than the review screen) may be suspended.
  • Entire agreement. These Terms, together with the Privacy Policy, COPPA Policy, Cookie Policy, and any terms presented at the point of purchase, are the entire agreement between you and QuizTime Labs regarding the Service.
  • Severability. If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will remain in full effect.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
  • Electronic communications. You consent to receive notices and communications from us electronically, including by email and in-app notice.
  • U.S.-based service. The Service is operated from the United States. If you access it from elsewhere, you do so at your own initiative and are responsible for compliance with local laws.
